In my view H1B problem is directly related to Retrogression problem. Lets step backwards and analyze this.
Why so many GC were applied at the first place that caused retrogression. Because a large number of people came on H1B to US. All these people who came to US on H1b did not actually had any extraordinary skills. These people somehow got in touch with these Desi Consulting companies and came here without any skill and without any projects. These desi consulting companies applied there GC irrespective of the fact that these guys have a job or not. Some of the people I know have sat on bench for years, living with their relatives, unable to get any job. But they had their labour filed. These knid of people would not have made to US, if these fadudent companies were not there.
Also big companies, have a policy not to apply GC before one year of service. The point was that these companys will file GC only if they feel that the employee adds value to the company. But with these desi companys people have filed GC even before joining the companys.
In essence if the GC process was working without these Desi companies, I can bet that the number of GC applied would have been much lower than what have we currently have.
Substituted labor has further added to this problem.
I cannot agree with you more. I have seen and met these fake consultants and their knowledge and skill level is zero. I can school most of these so called techies with 5-7 years of experience just with my couple of years of experience and a Masters degree.

What IV has done is commendable and unprecedented. I also think that most of us here do not know anything about the expenses incurred by IV team or money collected by IV team. It would be a good idea to be transparent in that aspect so that members can have a better understanding of the functioning of the organization and contribute appropriately. Just a suggestion; what do you guys think?
Slowhand, No Offense...If I were you, I would first contribute and then deal with this later. High time to contribute. If you have already contributed, please urge your friends to do so.

There is a funding drive in this other thread towards reimbursing Aman's expenses.
http://immigrationvoice.org/forum/showthread.php?t=10708
Could you please pledge an amount ?
Remember, most people are working hard and chances are that they may get fired for jobs doing this.
SO many IV members have been risking thier jobs to work hard on these things.
So many people have taken unpaid vacations, spent valuble time on this.
Kudos to Aman, Himanshu, Jwalant, and all other folks who are helping the community.
A lot of people are free riders, they come to IV for informartion only. A lot of people do not want to do anything, just because someone else is doing it for them. I have heard excuses from people saying "Don't you have anything else to do??? You will be fired from your job, I bet you, don't get disillusioned by these folks at IV, they cant move a stone"

Reverse brain drain will not happen with warning. But it is happening. I know 4 of my friends (Great guys) left US just because of the current immigration issues.
People might not take decission now, but when time comes, that happens all of a sudden, they will not protest or even inform any one, they just catch the plane. No one knows that it has happend.
But can you bring them back if you want. IMPOSSIBLE.
Also Imagin, US is in good situation (not really but OK.), so they are ignoring immigrants, imagin what happens if they want people tomorrow for their survival. With this background, I am sure that they are going to get only JUNK.

I deeply appreciate the follow up messages from nycgal369 and amitjoey, as well as the efforts of other members who are posting and reading messages...
Leave the PR and outreach efforts on Capitol Hill efforts to the core members. We need help from other members who are willing to dedicate their efforts to getting members. Talk to family, friends and colleagues. Talk to people in your classes, if you are taking part-time classes. Talk to your boss. Talk to your neighbors who are US citizens and get them to talk to Congressmen and Senators...send emails and letters to your Congressmen and Senators!
Once again, following up on what nycgal369 said, exactly what amount people contribute is in some ways not what we care first and foremost for. Please contribute what you can comfortably handle within your budget. Whether it is $20, or $ 50 or $500 is your call...the important thing is that people start contributing something...we need funds to support our lobbying activities. And please be assured...all expenses will be audited by a CPA. We are legally obligated to do this.
Another point that nycgal369 raised is about community outreach efforts...we are already in touch with organizations, both on the left and the right. Please leave that to us. Please help us out with recruiting members and with raising money...

I want to thank everyone for contributing their personal story, I as an immigrant understand the importance of Green Card. We have worked dillegently over the years, sacrificing our personal dreams, our spouses sacrificng their personal dreams.
I am an optimistic person and I believe we will see a positive response.
However with the current status of the economy, just asking for visa recapture will not help, we cannot bring a change based on one side of the bargain, what we need is a two way bargain. What we need to do is offer business deal, let them know that we do care about the economy and would like to contribute to make this country stonger, as it was in the past.
The congress will do anything to get rid of all these homes off the market, if we add our intention's of buying homes in a our personal stories, they will think it from their side of the benefit as well.
In all you stories please add you intentions to buy a home, as without greencard you do not want to take the risk.
The downfall of the economy started with the housing crisis, and the economy will bounce back with a substantial improvement in the housing market. WE NEED TO INCLUDE OUR INTENTION OF BUYING HOMES
Infact, we should also send emails to realtor association, let them know our intentions, so they can communicate it further to the congress.
Guys you all are incredible and have contributed your valuable time and effort in IV. So I humbly request you all to please channel this effort lucratively for the other side as well. Remember the quote? BEGGARS ARE NOT CHOOSERS

Cmon dude. We expect a better example to back up.
The example you state is a violation of anyone's civil rights...leave alone an immigrant.
No one is raping you by imposing a per-country limit on your green card application.
Congress used the power given to them by the Constitution to frame Immigration laws and they created a formula for regulation. Per-country limit is that formula which they had every right to create in order to uphold the balance of immigration in their country. Getting a GC is not anyone's right..its a privelege bestowed based on the applicant meeting certain criteria which includes quotas, as per the country's laws. There is NO civil rights impact. You are getting your green card in the end...only problem is they are making you wait 10 years because of that formula. But none of your civil rights are being impinged upon. So we should work to change flawed law rather than try to muddle the issue with civil rights. No matter what extreme example you give, you will still never be able to prove that your civil rights were impinged because you are having to wait for 10 years in a legal queue while your application is pending.
Don't get caught up trying to defend a stance no matter how irrelevant it may be. Its better we focus our time and effort on more achievable and valid provisions.
Good Luck to you.
Ok bye....... until next time :)

Lately the members of IV have come to know that Aman Kapoor, the co-founder of IV has sold his house and spent around $64000/- towards the administrative costs of IV. This too was brought to our attention from a regular member like you and me, without which this would not have come to our knowledge at all.
So some of the members have taken an initiative to reimburse Aman and other core IV team members with the expenses they have incurred so far towards the administrative costs of IV. Note that the time they have spent and the sufferings cannot be compensated. Let us do the least by atleast compensating the money. Please do not donate directly to IV funds.
There is a funding drive in this other thread towards reimbursing the administrative costs of IV.

People, since Aman and lets not forget other core members also who I am sure have racked up a lot of out of pocket cost we as a community should gather funds for administrative cost also. GC is not just Aman's/ pappu/logiclife and others core member's dream...its OUR dream, and its not fair that in spite of knowing the time and money spent by the core members we donot share the burden.
So here is what I am thinking, there are 21000+ members of which I think 10,000 can be considered the real people (I am sure there are more..but a real conservative estimate) if we all pitch in $10 for administrative cost I think it would not put any dent in our pockets and this collective effort would not create a financial burden on any of the core members.
Even though IV is not for profit, there is no rule which says that you cannot have funds for administrative cost. In fact one rule of thumb to give to any NOP charitable organization like united way etc is to look at their admin cost. Why not IV have that.
Any thoughts!
Lets not make this a core team fight only...people are jumping in the boat and asking all and any question they can..and when it comes to giving money they will say that..oh I cant no money...I am not a rich guy my self but managed to give $200 and now signed up for $50 yesterday...looking at what a lot of people are doing I think I might have to go to $100.

SLV profile in yahoo mentions it tries to hold instruments to match SLV performance.
GLD claims physical gold holding in their profile. There is not holding detail on yahoo finance.
It will be interesting to dig into their actual portfolio holdings. But I agree that these are probably the closest instruments on gold and silver price play.
Both these ETF's have huge loop holes that are well known in the pro circles. The very question that they are holding physical gold or silver is highly questionable considering the market cap of these ETF's. There is risk that they will not perform like the underlying at all.
The custodians of SLV is JPM who usually has a huge short position on Colmex silver and GLD is HSBC who has a huge short position on gold. Read this article for more info.
Are GLD and SLV Legitimate Investment Vehicles? -- Seeking Alpha (http://seekingalpha.com/article/149209-are-gld-and-slv-legitimate-investment-vehicles)
Again this goes to my point that trading commodities is not as straight forward as it seems even in plain and easy instruments.

Although we cite the cost savings (from renewal of EAD) most people if not all who prefer to keep H1 status will definitely renew their EAD/AP just to be safe. On the AP case, I got 3 copies of multiple entry APs. My attorney told me to make copies of it and give only copies at the POE and point out that it is a multiple entry document if the officer wants to keep the original, so that the original stays with you.
This is interesting. I am trying to understand the reason why we should give copies. If you have three copies, and at POE they take one and return two, how does that harm you. I mean what is the point of keeping all three if there eligibility is 1 year and you don't expect to go out of the country a second time.

The reason for your delay is because of a new rule instituted by the consulates. Here is a extract from MURTHY.com on that topic.
PIMS Verification Required for Certain Nonimmigrant Visas
Posted Dec 07, 2007
MurthyDotCom
The U.S. Department of State (DOS) issued a directive in November 2007 to the U.S. consular posts that the correct procedure for visa issuance in nonimmigrant categories H, L, O, P, and Q will now require consulting an electronic record. The purpose of the Petition Information Management Service, known as PIMS, is to verify that the employer's underlying petition has been approved by the U.S. Citizenship and Immigration Services (USCIS). Even if a beneficiary takes an original I-797 approval notice to the interview, previously sufficient basis for visa issuance, s/he now will have to wait until the information is confirmed through PIMS.
MurthyDotCom
Not Fully in Place, but Verification May Be Effective Immediately
MurthyDotCom
While nonimmigrant visa appointments can be scheduled on the basis of approved I-129 petitions and I-797 approval notices, per the DOS instructions now in place, no visas may be issued without verification through the PIMS system. Because no further guidance from the DOS has been issued as of this writing, some consular posts are taking the position that the new directive is effective immediately.
MurthyDotCom
48 Hours for New Approvals to be Available in PIMS
MurthyDotCom
Seeking clarification on the new electronic record visa issuance procedure, the American Immigration Lawyers Association (AILA) contacted DOS officials who indicated that, as of November 29, 2007, the data on approvals had not been electronically transferred. Where consular notification is requested, however, information on new approvals should be available in PIMS within 48 hours.
MurthyDotCom
Domestic Clearinghouse Option for Verification
MurthyDotCom
DOS has stated that, in the event that an overseas consular post cannot obtain verification of an approved petition through PIMS, it may submit a request through a domestic clearinghouse that can confirm with USCIS that a petition has been approved. The DOS, however, has failed to indicate the processing time for such a request or the number of cases it anticipates may not currently appear in PIMS.
MurthyDotCom
Conclusion
MurthyDotCom
How quickly or efficiently the new verification process through PIMS will work remains to be seen. Visa applicants who may be affected by this new process are encouraged to plan well in advance of their visa appointments so that they are prepared if the visa issuance takes longer than expected. We will continue to share updated information with MurthyDotCom and MurthyBulletin readers on developments regarding this new system.

As I see it, the only persons benefited are the ones having the priority dates in ancient times. I think we really should not mind letting them have their GC's, being our seniors.
Yes, later year porters might end up having to wait. It's all in the game, fortunately or unfortunately. One thing is for sure, we as a whole, have an uphill battle
If it really comes to matter, I think it should be easy for an EB2 to port to EB3 if the dates are current for him in the different category. So if I were EB2 today, I wouldn't be so apprehensive :)
I have neither become apprehensive nor have got any ill feeling ... just showing where the problem is .

Can you please explain little more about #2 ie. Open your own e-business and File E visa. What type of e-business to start? How to file E-VISA ? Have you filed yet ?
If anybody has any info on E VISA,please post here so that we can make use of it.
I appreciate your comments.
gimmi green - Don't you see green around you. Let me tell you how to get green
1) Use your credit history to purchase additional home in Florida. House purchase in 150000 will be 250000 in year. The market was like that a year back. It takes 8 months to get a house. There is a big line.
2) Open your own e-business. File E visa. 1/4 million should be easy money if you have stayed here for 10 years.
3) House listing in only done by realtor. Give option to customer. For fun open a site for people to list their house for sale. Give them free service then charge. Live American way.
4) Make school in Village. I have made one. I enjoy supporting the school. Grow India.
5) Don't worry about GC. Do something. Registering a site takes some $35 or 40. Built you site. Use American brain.
Am I doing it? Yes.. Did I make money? Yes.
Ensoy.

I just read the other thread linked to by 'internet' above & thought I would say a couple of things to the losers at alipac who worship racists like tancredo and lou: Don't distort this thread's message - we not are trying to gag Mr.Lou however much I puke everytime I see him spewing venow on 'aliens' -and I sometimes even admire his constant state of outrage and complete lack of shame. He and his worshippers at alipac are a reminder that bigotry may have been outlawed offcially in the 60's but definitely wasn't completely eliminated for posterity -a lesson to all those who forget history and think we have always been 'civilized'; we are the nation we are today because of the tireless work of so many great leaders supported by so many forward thinking Americans of all colors -so lets be clear - we WANT LOU to spew his venom and unvarnished bigotry in Detroit - we WANT alipac to worship such hatemongers so when youngsters wonder how people could have been done horrible acts in the past we can point to you guys and say 'here you go - now know that every generation has its bigots and its the duty of decent folks to oppose them - its a constant never ending fight!'

bringing bk the discussion to more serious point. We can all agree that on the surface immigration system here is seems unfair towards Indian, Chinese and Mexicans. Whats the reason behind it? why only three countries which suffers from long waits. Its demand and supply. If there were no country caps, all the visa's will be absorbed by these three countries. Even though it has cost me time and money, i think its the right policy. for a moment imagine there was no country limit, can you imagine for few years to come immigration will be from only these three countries. i think its only fair to limit how many people can come from one specific country.
and one more point, we are never going to get treated with respect and equality, just get used to it. every American knows we left our country to come to his. he is always gonna look down upon us. Immigrants are never treated with love, respect and dignity, no matter which country they go to. Case in point, Bangladeshi and Nepali migrant workers in India. We treat them like dirt back home, so discrimination against immigrants is part of immigration process. hopefully our ABCD offspring's will face less of it :)
