Agreed getting a GC is a painful process not to mention the bureaucracies that go with it.Agreed serious lobbying is necessary to bring about a change in the legislative system coz waiting for years to get ones GC is plain ridiculous.But the idea of REVERSE BRAIN DRAIN is just a myth.I am pretty sure that atleast 80% of the people are just average Joes whose intellect is just better than those blonde babes of the "Girl next door" reality series.We should be glad that we were raised in a foreign country lest would have replaced those poor old folks saying "welcome to wal-mart".So lets stop talking about reverse brain drain and atleast not try to replace those intelligent ones back home. We being here is best for our country and our economy.

Again, thank you all!
As a matter of fact, I am going back to France for 2 weeks next Sunday.
That's my first time there in 8 years...
I haven't told anybody yet about what happened recently.
They don't even know the whole story. Yes, all those years I had to lie, especially to my parents:I didn't want them to worry about me.
I was always saying: "I am fine, just fine.."
I am waiting for my friends and family to ask me the usual question:
"So, how come you don't have your GC yet? What are you doing?"
Then, I will have something to show them!

My wife and I had our interviews on Jan 3rd. Consulate handed the passport to VFS on Jan 4th. DHL (i think) delivered at home on Jan 5th.

IV now has clout which should be immediately used for a permanent fix. Two issues which might not require laws being passed can be implemented to ease the backlog situation that will be created.
1. Recapture lost Visa numbers- A just and reasonable demand that they cannot refuse.
2. Remove per country cap- It is stupid to look for diversity in a category based on intellect. The whole category is created for improving America's brain power so a country cap does not make sense.
Which is better to say" We want 10 people with OK intellect from 10 different countries of the world" or " We want 10 absolutely brilliant people-period"

This is how it works. If you file for your 485 now, the next thing that is expected from you is to wait for the receipt, that would take 3 to 4 weeks. Then you will get finger print notice, that might come in three months time. Once you are done with all this then check the processing date of the respective service centre where you have filed your 485 application.
Now coming to the question of unmarried filers, if the principal aplicant's date of marriage is beofe his or her 485 adjudication of adjustment of status, there are two ways principal applicant file for 485 for his or her spouse. The spouse can travel to US on H4 and file for 485 or the principal applicant can do consular processing. Now consular processing is good for those cases whosw w PD is current but since retrogression can kick in anytime it is better to travel to US on H4 and file for 485.
Another important aspect is if you file 485, EAD, Advance Parole and you use EAD, you loose your H1 status, hence on EAD you can not bring in your wife. So unmarried filersn it goes like thisn you go ahead and fileyour 485, then go to your home country brng in your wife on H4n as you have aleast s months of time if NSC, TSC or CSC 485 processing is not current and it is hown 1 month for receipt of 485, three months of time for getting the finger print notice and you can postpone by another month of FP by rescheduling it to another month. So literally you have 4 to 5 months to get married and by that time the dates will retrogress again. So dont worry, just go ahead file your 485 and start looking to get married. But try to bring in your spouse asap so that you can file for your spouses 485 also till the time PD is current. If you are not able to file for 485 for your spouse and you have filed for yourself and whenthe dates retrogresses again when your spouse comed to US you would not be able to use EAD as using EAD nullifies H1 and H4 status. So desi consulting companies will keep on sucking your blood as you cannot change job using EAD. If you need more info on this let me know I have gone through this and waited for almost three years to file for my spouse I resheduled my FP notice in 2004 to get married by the time my wife came retrogression kicked in and waited till June 2007 to file for my wife. Did you even read my post and the pdf link. BTW, pdf link refers to Aug 21st, 2009 much before this memo came out. Even if memo is withdrawn, how that is going to change the points agreed by the court?

Ok Logiclife, i did not intend to start a war or anything of the sort. I was just giving suggestions in light of the fact that inspite of IV working VERY hard, nothing is happening on the GC front. That is the ONLY reason I put up this post.
One more thing. You mentioned that a lot of people are not contributing, maybe the reason is that not everyone wants a GC that desperately. Some people are fine with working here temporarily and then going back after making some money. Besides some members who have contributed in the past may be wondering if it even makes sense to contribute again, being that there has been no real progress on the GC front since Dec 2005 (the birth of IV). Now do not get me wrong I KNOW how hard the IV team has worked and how many time we came SO SO SO close to getting our dreams realized in the Senate only to be crushed in the house again.
My point was, maybe it is time to face the facts. The government has changed but the basic attitude towards the "immigrant" is the same. This is because the average American, views immigrants as a threat. Now we can argue all we want on that statement, but in our hearts we know that the "AVERAGE American" would rather Not have immigrants come to the US (legal or illegal). In light of these events does it not make sense to ask for simpler goals? Goals like 485 filing or H4 Eads etc. Sure it makes us look weak in front of the anti-immigrants, but then are we here to solve our problems or to prove the anti-immigrants wrong?
Lastly this was NOT a threat nor was it intended to be a Threat that "take my advice or i will leave". Just a simple suggestion in light of things to come.
I know you are not threatening to leave. But eventually some one will. It always happens when one or other item is included or excluded from agenda.
Anyways, this isnt about looking weak or strong against anti-immigrants. That is really not the issue here.
Its about how much we can have in our list of items. There is only so much anyone can do. Forget about us, even bigger organizations have priorities in order. Immigration Voice also has to have a priority. We cannot talk to anyone about fixing the H4 issues before the issues of retrogression are talked about. And we cannot talk about ALL OF THEM because there is room for only so much to talk about. There is a limit on everything. Limit on how much funds we have, limit on how much political capital does our lobbyist spend on our organization with lawmakers, limit on how much leverage the lawmaker uses to sponsor an amendment for us. No one has unlimited capacity to get things achieved. So in that sense, H4 issues really cannot be on the list. And as far as "nothing is happening, let's get temporary relief and let's not fight for more numbers" idea is concerned, we are already doing that by trying to get 485 filing provision done in next few days as a temporary relief. Now tell me, how is that not tied to H4s. EVERY SINGLE ITEM on our goals benefits H4 spouses indirectly. Including the short term goals of IV.

Why dont you organize a rally, we will contribute and be their for the rally. We need to do something ASAP. I humbly request you and other core members to organize a rally and pick one day for sending flowers to either white house or USCIS. Also we can balck out our personal information and send our transcripts as well.
Please organize a date, how about February14th, we will get more attention. Love for permanent residency, media will like the idea and broadcast it.
What about hunger strike?
It is much bigger than rally. You will get more attention and you do not need thousand people to do it. If we can have even a handful of people or even one person to do it, it will be great. The expenses and preparation to do hunger strike will be very less.

Dont lose hope and dont lose sleep over it. I know it's easy to say...but just hang in there. Everything will be ok. As someone suggested, all you will be losing is at most 10K. Even that, you can transfer to some where else and should not be paying a cent. Why go now itself? Let's suppose that the judgement is not in your favour, may be , after a couple of years. Then you can quit your job and say you are leaving. I dont think they can stop you at that time. And I dont think they can make you work either, if you decided not to take up a job. Then file banktrupcy and go back to your country. Relax for a couple of years and then come back.
So, all i would suggest is stay calm and let the trial take it's course.
If you do not want to go through all this stress then as someone suggested , try for an out of court settlement. Tell them all you have is about 2K( take off all the money before that). It's possible that the target might not even be you. There might be some millionaire in one of the other cars.

You will not loose all of your hard earned money for such a normal case. I think, you should not hire a lawyer until you need to support yourself. Let the insurance company lawyer handle the case. Try to get all the information possible from company lawyer. And contact few lawyers personally & get advice. Keep the information, but do not hire. Hire a lawyer, when the company can not continue their lawyer any more.
