Zazona report goes wrong in two directions.
1. Benificieries of tax treaties among H-1B applicants are very small in number. They are from mostly European countries.

Even the H-1B immigrants who do not pay Social security taxes, however small their number may be, have a right to utilize this feature provided by their home country to safeguard their hard-earned money. They should not be blamed, ridiculed, villified for taking care of themselves in the retirement.

If you are not using a sub labor and filing 140 in a week or so, there is nothing for you to worry about.

I am not using substitution labor. I do not condone any one who does it for monetary reasons.
So the rule hasn't taken affect yet huh! I will definitely send my application out in premium processing this week. Just worried that I have passed the 45-day time period :( . Does my I-140 have to be approved before this rule is implemented, or just that my application needs to be filed ?

I am already financially/emotionally drained out due to my accident. I guess its going to be deja-vu for me again.
Now I have hardly any money in my bank accounts(around 14K to be precise), and no house , which seems to be a good news and they cannot rip off much.
Only questions I have now are:
1. Any idea generally how long these things can go on?
2. During the trial will there be any restrictions on leaving the country (In genuine emergency situations)?
3. In the worst case if I am willing to give-up my GC..would it still make sense for us(my spouse and 2 kids) to go thru all this emotional stress all over again by staying here and thinkign about what will happen tomorrow...?
One more suggestion:
1. Start withdrawing cash from bank accounts and leave the cash with someone whom you trust.
2. US can put pressure Indian counterpart to freeze your Indian bank accounts, hence don't tranfer monies in any of your or your wife's accounts.
3. Keep liquid cash on hand (not even in bank's safe deposit box)
Just thinking out loud.
Hang in there.

In any case, why should someone be SO disturbed if some lawyer says "I will try to prove your degree equivalency for trying to get into EB2"?
Going by folks' behavior here, I am inclined to think, some simply hate such a lawyer for nothing more than personal interests

I totally agree with supporting IV.
The question is none of the Admin fixes in last one year has helped EB3-I. In fact, it made our situation even worse.
it may look like it that it has made our situation worse. But it was never good to start with. The visa number flow was going to EB3-ROW. Now it is going to EB2-I. That is good since if EB2-I becomes current the flow would come to EB3-I as we have older PD people than EB3-ROW.

Another thing that can help is removal of country quota. With so many EB2 people getting their GC, we are going to need to really work towards getting contributions for lobbying since the people who get the GC cannot be expected to help IV anymore. We always were at the bottom and are still at the bottom. We need to unite and work with IV so that we call can get what we want.

Why don't we all put an end to finger pointing and concentrate on what we need. If someone is doing wrong or has followed wrong ways, govt may/may not take care of them, it is upto the govt, why do we always blame fellow citizens or immigrants?
We all know, people immigrate doing manipulation, being illegal, over stay visas, jump fences, modify resumes, etc...... at some stage everyone of us would do some level of manipulation so why finger pointing?
Making our lives better and fixing retro is the goal why drag in consulting companies.

You have to have security clearance before you can do that.
Pretty much like you have to have citizenship before you can vote.

2. No need to maintain GC status, even if I spend >1 year out of US

The Mexico F2A and Employment Third preference cut-off dates are �unavailable� for both August and September, since those FY-2008 annual limits have been reached. The Visa Office had originally anticipated that this would be a temporary situation. Then with the start of the new fiscal year in October the cut-off dates would have returned to those which had applied during June. However, continued heavy demand in those categories may require the establishment of cut-off dates which are earlier than those which had applied in June. A formal decision determination of the October cut-off dates will not be possible until early September.

Based on this poll, can somebody predict EB3-I movement starting Oct'2008?
The dates moved from Apr'2001 to Nov'2001 last year when EB3-I didn't recieve any spillover. So what would be the movement when new year starts?

We should update the question in the poll and make it specific only for people who live in and around of bay area, else the 'no I cannot attend' will be from all IV members who have no way to attend since they dont live in the bay area.

I talked to my lawyer about this. They have filed about 300 applications on July2'nd(reached USCIS on July 2). They haven't gotten a single application back. I think we can relax. July 2 applications are in the beginning of the queue and should get receptis after the june applications are done.

Point is all want GC fast. That will not come by fighting between EB2/EB3.
It takes realization of how important skilled immigrants are to US economy.
