Only questions I have now are:
1. Any idea generally how long these things can go on?
2. During the trial will there be any restrictions on leaving the country (In genuine emergency situations)?
3. In the worst case if I am willing to give-up my GC..would it still make sense for us(my spouse and 2 kids) to go thru all this emotional stress all over again by staying here and thinkign about what will happen tomorrow...?
Last thing you want to do now is to lose hope. You have gone through a lot of stress, but you've got to fight this out!
1. This could take about 1.5 - 2 years to resolve. At the end of that, there will either be a settlement or a trial.
2. There will be no restrictions to leave country, but you might be expected to be in court on trial dates. Again remember, a very small number of such cases actually go to trial- most are settled out-of-court. If yours doesn't end up in a trial, you will never have to actually go to court.
3. No need to give up your GC dream! Since you do not have any property/assets here, you have nothing to lose.
Cheer up!

Logiclife - you hit the nail on the head yet there are other reasons for folks not being active or contributing. I've talked to a lot of folks who have no clue about the green card process - how it works, how long it takes etc - and yes , they have been in the US for more than 3 years - Ignorance is such a bliss sometimes :-) until someone wakes them up - then there are folks who have filed their GCs but arent really looking forward to stay here - they have plans to go back eventually and really dont care about GC - there are lots of reasons - bucketing everyone of them under "they are afraid to contribute/participate" is not right - yes, I know I'll be flamed to hell for saying this :-) - but me being me - cant stop myself from sharing this.

Paskal, You are right - I do not understand. But mostly I cannot understand because as an organisation - you do not explain. Frankly, all I can do is register my disappointment at both your response and your attitude. While I get it that IV is actively involved in doing things over the years aimed at resolving this issue, I might feel that I could respect and maybe even understand these efforts better if IV kept its website up to date and all members who sign in updated on what's happening.
I have often seen threads on this site that have members complaining that IV is not doing anything - to which invariably the response is that one should join the donor forum. On the other hand we get newsletters from admin that ask up to tighten our belts etc. - and get more involved. Well, that cannot happen unless IV provides more updated information on what IV is actually doing, veiled references to behind the scenes activity and years of hard work are not enough to involve all those who have signed up here to become 'more involved'.
As for this discussion going nowhere I could not agree more - you see to have an open discussion or indeed debate - there must be at least 2 willing participants. And since you have already decided that you do not have time for the Qs of a mere non-paying member of this forum, I do not expect any better.
By the way, the way ahead is not to close doors, but to welcome questions and encourge those on this forum with curiosity to be more active. More often than not, I have seen that those who Q on this forum, are mocked, ignored, and treated as if they are wasting CORE's time. Sad for a forum that hopes to involve a wider audience in this issue.
Thanks!!
Raji
As a new user, I would try to understand what IV stands for, What political forces IV is against and have some political wisdom before I start asking IV to disclose everything in a public forum. There are valid reasons why IV is not revealing everything in a public forum. If you are interested in resolving your own GC issues and that of others on this forum, you should not ask IV to disclose all the strategies and thoughts in a public form.
There are many IV members who are old members of IV who trusts IV core leadership blindly even though we don't know IV strategies or thought process completely. One thing many of us can assure you is that IV core works with best of our interests in mind, they are a bunch of dedicated and smart people who understand how to plan our advocacy effort wisely.
I would suggest you trust IV core leadership with their advice and directions as it is better for our own interests.

There is no dearth of MORONs here. Here's another one. First Moron snathan asked me for website one may ask why? just because my handle was similar to somebody's.. Now this Moron RollingStone12 thinks i am PlainSpeak for reasons only moron can come up with and is asking for address. I doubt if he will be willing to 125 St Harlem.. but you never know he might just because he is a complete MORON... so I am scared to give out my address :p
YOU two will make a greate MORON DUO
Again you win....I dont have the capability to fight with a Slut...now go back to your hole, take a pill and sleep and come back as PlainSpeak.

Guys,
Lets not fight here. People in pain will cry, whether in EB2 or EB3 or any.
The system is broken and we must make sure its fixed.
Hope we know how people came here 60 years back. They got citizenship on day one. So what do we do. Things change, but there must be an order.
We must contribute to an organization thats trying to help us. Lets not be different to it. We are not living in any ideal world.
Did I contribute till now.. no..
Was I trying to in the last two weeks.. YES..
Let me do it tomorrow for sure.
Sri..

Probably most of you are aware of these things. So, let me say this advice is for newbies in the job. Lay-offs are done for business reasons and cost considerations. An American friend of mine lost his managerial job after 18 years of loyalty and experience. Company did not see the reason to continue to be in that business and the entire division related to the business was laid off. So working hard is good. Definitely a deserved trait. Do it for self-satisfaction, but not out of fear of loosing the job. At the same time, we should not be cloistered within the company working long hours. There are other things imprtant in life apart from the eight hours we spend at the office. I tend to my hobbies to keep my sanity after work. I look out for business indicators/news regarding how my company is doing. Good financial planning mandates savings around 6-12 months of living expenses which would lessen the impact of lay-off.;)
Yes I learnt this the hard way when I was fired from a fulltime job after working 4 years and contributing with a lot of hard work and dedication. I was fired in less than a minute and I was in 6th year of h1b. LOYALTY TO JOB MUST NOT BE FOR THE REASON THAT THEY HOLD YOUR VISA AND GREEN CARD. I moved out to consulting company and now work on %age and now I don't really care about being artificially loyal to any client. This is more healthy, resume gets built and you do not have to worry about losing your visa and status as long as you are in project, and as such changing projects is not difficult these days.
Most of the immigrants tend to be artificially inclined and have love and affection towards their companies just because Green card process is going on. Companies love to be cuddled by you but will not go out of their way for you.
The very reason logiclife and other folks started this group is because we are on our own. It is a fact that we are at no advantage with retrogression. Offcourse there are choices and one always has choices. Keeping quiet and accepting crap is not right. Whether we succeed or not, we must not accept crap as "fact of life". There is a saying "If you can walk, you can work".
I also agree that "working long hours + artificial loyalty" on h1b just for a GC is not proper reasoning for this cause. The actual reason behind this cause is a broken system that definitely needs too be fixed.

AC21 is a law but certain provisions of AC21 have been introduced in separate memos.
Job portability under AC21 is also part of a guidance / memo - so if any AC21 case goes for hearing in an immigration court, any change of employers while 485 is pending is considered illegal. This is not very common though.

have also used IMG/Sirius for my mom.100k with $100 deductiible.
Is this company not recommended? How do they compare with others? Please clarify.
IMG is good plan and recommended. IMG has comprehensive coverage plan that provides much better coverage than the fixed coverage plans.
Even look at the previous post from hope_4_best. They paid everything for a claim, except of course, the deductible and coinsurance. Also, look at the experience from jgs_res, they paid in his case also. Therefore, it seems that they have a good history of paying the eligible claims.

Thanks for all the replies! I already contribute to IV, so all the mails about contributing to IV can stop :) You dont need to sell me IV.
I am considering an opportunity, but if I leave I might lose my PD as my current employer does withdraw the I140.
Without any reform, my guess is it is going to be 5+ years for my date to be current. Just wanted to hear a few other opinions.
Also, if there is any impending relief (like 485 filing by 2/15 thats being discussed), I would be interested in hearing about it. It would be terrible for me if I move and then a relief is passed immediately in the congress.
Folks
Keep the jokes aside, this is not another thread which come up every now and then ( as i thought initially).
This is really serious question or looking for serious opinion.
Aristotle : if you have doubt that your earlier 140 will be canceled, once you move to new job , then consider waiting ( till 02/15 atleast)

It very well could be deliberate, no rejection notices mean, the lawsuit will be weak.

Another Iowan from Cedar Falls wrote in support of our review of the H-1B program. He is a computer programmer with a master's degree and over 20 years of work experience in that field. He says: Despite all of my qualifications, in the last four years I have applied to over 3,700 positions and have received no job offers. He believes he is in constant competition with H-1B visa holders.
The unemployment rate is 1.8% which is much lower then unemployable rate. Some persons are unemployable. That is, they will not get a job even if H-1B quota is set to 0.
The ONLY way for such persons to get job is with the legilative fix: every American is entitled to a job!
