Meanwhile, my lawyer today emailed & confirmed that the h1b will be valid even after using AP to travel and one can also renew or transfer the h1b. Even after the current I-94 expires obtained using AP, if one has still valid EAD or H1B I-797, he/she will be in status. However she also said that this is tricky situation and she could not find any CIS memo.
HOPE THIS WILL STILL SOLVE MANY PEOPLE'S DOUBTS.
Now I see no reason why anyone should NOT use AP to travel. Why should ANYONE waste money and time for restamping and take a small chance???

does this mean that EB3 ROW can't use all available visa for 3rd qtr that is why there were visas available for India EB2 (hence the established cutoff date of Dec 2003). but this should only happen if EB3 ROW is current but it is not.

Anybody has this situation?
My case was sent by my attorney June 29th (current July bulletin) USPS certified mail.
As per USPS online tracking record it was delivered July 2nd 12.45 PM.
No receipt yet. So far sounds okay.
But I got the copy of actual delivery receipt stamped by F.Heinauer (Director NSC USCIS) with the date 062907.
It is a stamp so some of their employee clearly has stamped it.
Now I am confused if that’s the receipt date they are going to go with and may reject the application.
And with this many application it may take more than AUG 17th to receive anything back.
I am very sure it was reached on July 2nd. It was only sent June 29th afternoon.
And USPS is telling there is no delivery can reach so fast. According to USPS the guy who might have stamped the delivery did not changed the stamp date from 0629 to 0702 since it was a weekend.
Anybody in the same situation? Any advice?

You said it. Some years ago people who filed in wyoming get lc in 3 months
and got GC in 1 year. I know a friend who completed the whole process in 11 months :)
What to do? This world is a big unfair place. we have to live with that I guess.
Congrats buddy ! Its quite ironic that there are some people who filed a few months here or there from your PD in 2000/2001 and are still waiting for their GC and I know a few people who filed for GC in 2003/2004 and got it in 2005.
The odds of getting lucky with USCIS are worse than hitting the jackpot .

We do have a right to request prompt, fair service.
We do have a right to expect to be treated by the system as we treat the system: with respect.
If we do not actively seek to change the system for the better, then who will?
There is no injustice that some justify with "well, he's illegal!" or "He's not American!" It is not acceptable. Not just because it is unfair to us, but because there are no bounds to it.
If early Americans just accepted how the British treated them, there would be no United States. Not arguing for revolution, but I am saying that any efficiency that exists today exists because of the demand for it. Regardless of citizenship.

looking at the sarcastic, venomous and abusive responses, make me wonder why some people are so insecure and touchy. Why is there a my way or the highway mentality. Or may be some are happy living in illusion and don't wanna be shown some reality. couple of points
1) again none of us will be treated same as American. Some of you mention BO as role model, remember his mom was American and he was born in Hawaii. had he been born in Merrut, you wont have been talking bout him.
2) I got canadian PR not because i want to move there or anything. I got it cause its a good backup. If things dont go right in India, i can always come back for few more years. But this time it will be Canada. And before you guys start crying again, Canada has no problem with someone keeping a PR as long as he spends 2 out of 5 years in Canada.
Again, just the sheer number of people from India, China and Mexico running after PR ensures there is a long waiting line. No way around it. So either wait for your turn, or explore other alternative. If you want to spend time howling, crying and protesting, well good luck with that too. It only makes American look down on us as GC seeking lowly, noisy, needy immigrants.
Look up how immigration is done in NZ, AUS and Canada, that's a dignified way and then there is this USCIS way which humiliates you at every step. So the choice is there, its just tht we r too stuck with american GC

Every bank is here to make money. I do transfer money through SBI and ICICI , didn't find any difference as far as rates are concerned. Services at ICICI are much better than Sarkari SBI. At least you can do many things with ICICI by sitting here rather than SBI.
Switching is not a good option, What you gonna do if other bank also doing with you the same thing. I would suggest complain it with RBI whatever you are not satisfied with.

Ok, so here are some more thoughts ... obviously we are all stuck in our current positions and we are worried about the future. Unless, we do something to be prepared we won't be better off when we get our GC's? Given where most of us are I think we have two options:
1. Advance your education (MBA/PM/certifications etc.)
2. Start a business.
I would like to hear from everyone who has or wants to start a business.
1. Have you thought of starting a business?
2. What does it take to start a business while on H1B
3. Is it worth the effort not knowing if/when you will get the green card. Remember starting a business is not a short-term goal.
4. Are there businesses that cross borders i.e. we can continue to run the business even if we have to leave the US?
