I think , of what Mr. Logic Life said summarizes and represents the state of us all , who wish to obtain a Green Card and are on H, L ect. VISAS.
I think, It is absolutely right "We deserve fair and speedy immigration.".
Opportunity of working in America is great ... but when skilled professionals will have to choose H1,L1 or GC , they land in an unpleasant experience, that goes on for ever until they obtain their GC.

Hi Priti, thanks for the reply. However my fear is that what you say is not true. I am on my 7th yr extension of H1B and my lawyer has told me that once I apply for 485, I can NOT keep renewing my H1B. That is why he insisted on applying for AP.
Is this information correct? Can someone PLEASE clarify??? :confused:
As far as I know you can extend your H1B by 3 years IF you have your I485 receipt number.Ask your lawyer about this.

Once you start using EAD your spouse's non-immigrant visa status(H4 status) will become invalid. That means once you work on EAD you will not be able to bring your wife here. As long as you do not work on EAD, you can have both H1(3 years) and EAD. .
If your PD is eb3 India 05 or 06 you dont have anything to worry about for at least a year or two.

It reminds me this story every time I visit IV.
Workers working with an export company which use to ship chickens from all over the world to US/Europe, were packing chickens from some Indian port. Each box was having some 50-70 chickens in it .
After loading them in, they were about to cover these boxes with the tops. The leader shouts to workers: " No need to put the tops. They wouldn't go any where "
Surprised with this order, one worker asks the leader 'Why'. The leader says : " These are Indian chickens. IF one tries to escape, other will pull its leg."

If there is any such program to contact any senator, it will be announced by IV core through State chapters network. That's the purpose State Chapters were created! Right now no such action plans exist!
A sincere request to anyone, DO NOT create your own 'Action Items' on Legislative actions. Reason being, legislative matters are delicate and need careful handling. If handled without a holistic perspective and professional advice - which only IV core can provide - may backfire and harm IV cause, instead of helping it!

I dont think companies are really geared to file for 140 within 45 days of labor approval.
Most of the companies take 4-6 weeks to just send the documents the lawyers request for filing 140. Then the lawyers, most likely forget something and request more documents. It takes another 2 weeks for company to send those.
All in all, on average I think companies need 3 months after approved labor to be ready to Fedex that 140 petition. No malicious intent on the part of employer, its just how things are. 45 days is going to make things difficult for many companies and many of the lazy, slow, procrastinating law firms.
When the Dept of labour can process PERM in generally 6-8 weeks or less and the USCIS can offer premium processing of 140 in 2 weeks or less, what the heck is wrong in expecting these large companies and law firms to get up off thier lazy slow procrastinating backsides and file within 45 days?
That said, in the final ruling I suspect they will make some modification to this time frame.

Here is what I have understood from my lawyers -
DOL decree, if adopted, will prevent any further labor substitution.
Any labor approved after the decree is adopted cannot be used for substitution.
Any 140 application based on labor sub will not be denied until USCIS adopts a similar resolution - it is unlikely that USCIS will do such a thing as it will lead to lawsuits from lawyers and folks already in the queue
People with already approved 140 do not need to worry at all.
I am laying down the facts here such that people can make educated decisions on what they want to do.

Hey,
I have Bachelor's computer's 3 years and MCA 2 years from IGNOU. I have over 7 years of Exp excluding frm my current company. Is EB2 possible in my case. My employer says its not cause of my education, can anybody let me know if they have done EB2 with this scenario. Appreciate your time. Thanks

I don't get this. Who is sponsoring this person's GC? He must have a sponsor to get the EB-based GC. He can't show his job skills as cooking !!:)
A desi consulting company brought him to the US. When they realized he wasn't going to get a project, they just didn't let go of him. Since he was a reliable guy (1. he can be trusted with monthly grocery payment 2. his labor can be sold later to others 3. he servres as an insider who can get information if other consultants are trying to be sneaky by getting their resumes marketed by another company, etc etc, basically he is an asset even thought he doesn't have a project), they just decided to keep him there. These companies don't have attorneys. They take care of all legal matters themselves. Now, how much is hte USCIS fee to file for labor? How much to file for I-140? Peanuts right? So they continue to keep his application active. How hard do you think it is to get fake references when you can make fake resumes. They have fake pay stubs. Fake experience. Fake this and fake that. Everything they do is fake.
So to others who have said that this thread has to be dropped, and have said that these desi companies are right in doing what they're doing, or who have blamed the system - I think that you are one of those people who are involved in such a racket. I know that I have touched your nerves by letting the whole world about this (not that some people didn't know this already). Why else would you want this thread dropped?

Great work IV for making this happen. But I agree with the concerns of backlogged EAD/AP. I think we should work with USCIS towards issuing interim EADs atleast . Else it will take 1-2 years just to get a receipt...That would defeat our purpose.
So what did we acheive? Just moved the backlog from "waiting to file I-485 to waiting for EAD" ? And I am not even talking about getting the GC .Who knows when we will get that?

This was my first time taking part in an immigration movement. I was a bit nervous, but it was easy...called 3 in 3 mins. Will be calling other half later in the afternoon.
